Please read these Terms of Service carefully before using Pluum. By downloading, installing, or using the Pluum app, you agree to be bound by these terms. If you do not agree, please do not use the app.

1. About Pluum
Pluum ("we," "us," or "our") is an AI-powered music player app available on iOS and iPadOS. It offers a curated library of AI-generated music tracks, scene-based templates, and — for subscribers — AI music generation capabilities.

2. Subscriptions & Auto-Renewable Billing
Pluum offers auto-renewable subscriptions. Please review this section carefully before subscribing.
2.1 Subscription Plans
Pluum Premium is available in the following auto-renewable subscription plans:

2.2 What's Included in Premium
- Unlimited access to the full Pluum music library
- AI music generation: create custom tracks using AI, with full ownership and commercial-use rights
- Scene-based templates and curated playlists
- Ad-free listening experience
- Priority access to new features
2.3 Free Tier
Non-subscribers may access a limited selection of the music library for personal, non-commercial streaming. AI music generation and commercial-use licensing are not available on the free tier.
2.4 Billing & Automatic Renewal
Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
Payment is charged to your Apple ID account at confirmation of purchase and upon each automatic renewal. You can manage and cancel your subscription at any time in your iPhone/iPad Settings → [your name] → Subscriptions, or in the App Store under your account.
2.5 Free Trials
If a free trial is offered, it will be specified at the time of purchase. Any unused portion of a free trial period will be forfeited when you purchase a subscription. If you cancel before the trial ends, you will not be charged.
2.6 Cancellation Policy
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access to Premium features until then. We do not offer refunds for partial subscription periods, except as required by applicable law or Apple's refund policy.

2.7 Price Changes
We may change subscription prices at any time. If we change the price for your subscription, we will notify you in advance and you will have the opportunity to cancel before the new price takes effect.

3. AI Music Generation
3.1 The Service
Premium subscribers may use Pluum's AI music generation feature to create original music tracks based on text prompts, moods, or scene templates. Generation is powered by third-party AI APIs (including but not limited to Mureka).
3.2 Ownership of AI-Generated Content
Tracks you generate using Pluum's AI music generation feature are owned by **you**. You retain all rights, title, and interest in and to the music content you personally create through our platform, including all copyright and adjacent rights.
This ownership grant applies only to tracks generated by you using the AI generation feature. It does not apply to pre-made tracks in the Pluum music library (see Section 4).
3.3 License to Generated Tracks
Premium subscribers receive a **full commercial-use license** for all AI-generated tracks they create, including but not limited to:
- Use in videos, films, podcasts, and social media content
- Background music for commercial projects
- Distribution on streaming platforms
- Any other lawful commercial or personal use
You may not resell or sublicense the tracks as standalone music products (e.g., selling them on stock music platforms or claiming third-party ownership).
3.4 Prohibited Inputs
When using the AI music generation feature, you must not submit prompts or inputs that:
- Infringe third-party copyrights (e.g., requesting direct reproduction of a copyrighted song)
- Contain hate speech, violent, or sexually explicit content
- Violate any applicable law or regulation

4. Pre-Made Music Library
Pluum provides a curated library of over 1,000 AI-generated tracks. All library tracks are owned by Pluum and licensed to users for personal, non-commercial streaming during active subscription. Unlike tracks you personally generate, library tracks are not eligible for user ownership or commercial use. The library content may be updated, modified, or removed at any time at our discretion.

5. User Conduct
You agree not to:
- Record, copy, download, or distribute any music from the Pluum library without authorization
- Use any music content to train machine learning or AI models
- Attempt to reverse-engineer or extract audio from the app
- Use automated scripts or bots to access the service
- Interfere with or disrupt the operation of the app or servers
- Misrepresent your identity or impersonate any person or entity
Violations may result in immediate suspension or termination of your account and subscription, without refund.

6. Intellectual Property
The Pluum name, logo, app design, and all proprietary technology are owned by Pluum and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use Pluum's trademarks or branding.
If you believe content on Pluum infringes your intellectual property rights, please contact us at [email protected]. We will investigate valid DMCA-compliant notices and take appropriate action.

8. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the app will be uninterrupted, error-free, or free of harmful components. We are not responsible for third-party services, APIs, or content linked to or accessible through the app.

9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PLUUM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP OR THESE TERMS.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO PLUUM IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Changes to Terms or Service
We may update these Terms at any time. When we do, we will update the "Effective Date" at the top of this page. For material changes, we will notify you through the app or via email. Your continued use of the app after changes are posted constitutes your acceptance of the updated Terms.
We may modify, suspend, or discontinue any aspect of the service at any time, with or without notice.

11. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved by binding arbitration in Delaware. You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class or representative proceeding.

12. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions will continue in full force and effect.

13. Apple-Specific Terms
Pluum is available through the Apple App Store. The following terms apply with respect to Apple Inc. ("Apple"):
- These Terms are between you and Pluum only, not with Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, to you. To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims relating to the app or your use of it, including product liability claims, consumer protection claims, or intellectual property infringement claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce these Terms against you.
Subscription purchases are processed through Apple's in-app purchase system and are subject to Apple's Media Services Terms and Conditions.
